Terms and Conditions

1. Scope of Application

These Terms and Conditions ("T&C") apply to all contractual relationships concluded through our website (www.card4u.org) and any related applications or services ("the Service") between Card4U and you as our customer. These T&C apply regardless of whether you are a consumer, business owner, or commercial entity.

(2) All agreements between you and us in connection with the use of the Service are governed by these T&C, our written order confirmation, and our acceptance notice. In case of conflict, these T&C take precedence.

(3) The version of the T&C effective at the time of contract conclusion is controlling. We reserve the right to update these T&C from time to time. Changes will be announced on our website, and continued use of the Service constitutes acceptance of the updated terms.


2. Contract Formation

(1) The presentation and advertising of postcards on our Service does not constitute a binding offer to conclude a contract.

(2) When you submit an order for customized postcards by clicking the "Order Now" or similar button on our Service, you make a legally binding purchase offer.

(3) A contract is concluded only when we accept your order through an acceptance notice or by processing and dispatching your postcards.

(4) We reserve the right to reject any order without providing reasons. We will notify you immediately if we cannot fulfill your order.

(5) Minimum order value: We can only process orders with a minimum value of EUR 1.99 or equivalent in other currencies.


3. Right of Withdrawal

(1) Our postcards are customized products manufactured according to your specifications, including your selected images, text, and design choices. Under applicable consumer protection laws (specifically Section 312g(2) No. 1 BGB and similar provisions), customized goods manufactured to consumer specifications are generally excluded from standard withdrawal rights.

(2) Therefore, you acknowledge that you have NO RIGHT OF WITHDRAWAL for customized postcards once your order is confirmed and processing has begun.

(3) However, if you are a consumer in a jurisdiction with mandatory consumer protection rights that cannot be waived, those rights remain unaffected by this clause.


4. Delivery Terms and Conditions

(1) We are entitled to make partial deliveries where reasonable.

(2) Printing and Shipping:

  • We are not responsible for shipping time. Actual delivery times depend on the carrier and destination.
  • Shipping Estimates: Any delivery time estimates provided on our website (including standard and express shipping options) are estimates only, based on carrier information and historical statistics. These estimates are not legally binding and do not constitute a guarantee of delivery by any specific date. Actual delivery times may vary due to factors beyond our control, including carrier delays, customs processing, weather conditions, and other unforeseen circumstances.
  • We will do our best to print and ship your postcards as soon as possible. We commit to processing orders for printing and shipping at least once per week.
  • We consider your card ready for printing and shipping only after we have received your full payment.

(3) Risk of Loss: Once your postcards are handed over to the shipping carrier, all risk of loss passes to you, including damage during transport. We are not liable for damage, loss, or delays occurring after handover to the carrier.


5. Pricing and Shipping Costs

(1) All prices on our Service are gross prices including applicable value-added tax (VAT) and all applicable shipping costs.

(2) Shipping costs are included in our displayed prices. The total price, including VAT and shipping, is shown to you in the checkout page before you confirm your order.

(3) We reserve the right to adjust prices for changes in VAT rates, currency exchange rates, or shipping carrier rates. Price changes will be announced in advance on our website.

(4) Additional fees may apply for special delivery requests, express shipping, or non-standard locations.


6. Payment Terms and Conditions

(1) Payment becomes due immediately upon order confirmation.

(2) You may pay using the following methods:

  • Bank transfer (SEPA)
  • Direct debit (SEPA)
  • Debit card (EC/Maestro)
  • Credit card (Visa, Mastercard)
  • PayPal or similar digital payment services

(3) For bank transfers and direct debits, we will process your payment at the earliest at the time specified in section 6(1). Any authorization you provide for direct debit remains valid for future orders unless you revoke it.

(4) You may not set off claims against our invoices unless your counterclaims are legally established or undisputed. You may set off claims arising from defects or counterclaims from the same contract.

(5) Your right to retain payment is limited to counterclaims arising from the same contract.

(6) SEPA Direct Debit Notice: By selecting "SEPA Direct Debit" as your payment method, you authorize Card4U to collect payment from your account via direct debit. You also instruct your financial institution to honor these direct debit transfers according to the terms of your account agreement with them. You may request a refund within eight (8) weeks from the date your account was charged, subject to your financial institution's terms and conditions.


7. Retention of Title

The postcards delivered to you remain our property until we receive full payment of the purchase price and all shipping costs.


8. Warranty and Guarantees

(1) We warrant that the postcards will be manufactured and delivered in accordance with our normal industry standards and your specifications as submitted at the time of order.

(2) Statutory warranty provisions apply to defects in the goods delivered, with a warranty period of two (2) years from delivery.

(3) Photo Quality Disclaimer: We do not warrant the quality of photos or images you provide. You are solely responsible for ensuring that your images meet the required specifications, including resolution, color profile, and format. We recommend verifying image quality before placing a paid order. We cannot be held liable for quality issues resulting from poor source images.

(4) Color Variation Disclaimer: Card4U assumes no liability for color variations between your original digital file and the printed postcard. Color reproduction depends on various factors including screen calibration, printer settings, and materials used. We provide a color preview during the ordering process as a guide only.

(5) Transport Damage: We cannot assume liability for damage occurring during shipping or transport after the postcards are handed over to the carrier.


9. Data Storage and Backup

(1) No Guarantee of Data Storage: Card4U provides NO GUARANTEE regarding the storage, preservation, or retention of any data you upload to our Service, including but not limited to images, postcards, designs, personal information, or any other user-generated content.

(2) Data Loss Risk: You acknowledge that all data uploaded to our Service, including high-resolution images, postcard designs, and project files, may be deleted, lost, corrupted, or rendered inaccessible at any time, including due to:

  • Technical failures or system errors
  • Server maintenance or upgrades
  • Security incidents or breaches
  • Hardware failures
  • Natural disasters or force majeure events
  • Our discretionary deletion of inactive accounts
  • Account termination or service discontinuation

(3) Data Backup Responsibility: You are solely responsible for maintaining your own backups of all important data, designs, and images. We strongly recommend that you download and store copies of all your work locally before and after uploading to our Service.

(4) Limitation of Liability for Data Loss: Card4U is NOT LIABLE for any loss, corruption, or deletion of your data or user-generated content, regardless of the cause. This includes loss of images, postcard designs, project files, or any other information you store on our platform.

(5) Data Retention: We may delete data from inactive accounts without notice after an extended period of inactivity, as determined by our internal policies.


10. Limitation of Liability

(1) We are liable for damages caused by intent or gross negligence according to applicable law.

(2) For other cases, we are liable only for breach of essential contractual obligations (cardinal duties) that are necessary for proper contract performance and on which you can reasonably rely. Our liability is limited to foreseeable and typical damages. This limitation explicitly includes data loss and deletion.

(3) In all other cases, our liability is excluded, except for:

  • Damages arising from injury to life, body, or health
  • Product liability under applicable product liability laws
  • Mandatory consumer protection provisions

(4) We are not liable for indirect damages, lost profits, lost savings, or business interruption.


11. Intellectual Property and User Rights

(1) Your Representations: You represent and warrant that:

  • You own or have the right to use all images, text, graphics, and other content you upload to our Service
  • Your content does not infringe any third-party intellectual property rights, including copyrights, trademarks, or publicity rights
  • Your content does not violate any applicable laws or regulations

(2) Indemnification: You agree to indemnify and hold Card4U harmless from any claims, damages, or legal action arising from your content or use of the Service, including claims by third parties regarding intellectual property infringement or other rights violations.

(3) License Grant: By submitting your content to us, you grant Card4U a non-exclusive, worldwide, royalty-free license to:

  • Process and modify your content as necessary to produce the postcards
  • Display your content on the postcards
  • Share your content with our printing and fulfillment partners
  • Share your content with shipping carriers as necessary for delivery

(4) Content Restrictions: We reserve the right to refuse to manufacture or dispatch postcards containing:

  • Racist, hateful, or discriminatory content
  • Obscene or sexually explicit material
  • Content that violates intellectual property rights
  • Threatening, harassing, or abusive content
  • Content promoting illegal activities
  • Any content we believe violates applicable laws or third-party rights

12. Privacy and Data Protection

Your personal data is processed according to our Privacy Policy and applicable data protection laws including the GDPR. By using our Service, you consent to the collection and processing of your data as described in our Privacy Policy.


13. Service Availability and Technical Issues

(1) We strive to keep our Service available 24/7, but do not guarantee uninterrupted access.

(2) We may temporarily suspend or take the Service offline for maintenance, updates, or technical reasons. We will provide notice of planned maintenance where reasonably possible.

(3) We are not liable for temporary service interruptions or data loss caused by technical issues beyond our control.


14. User Conduct

You agree not to:

  • Use the Service for unlawful purposes or in violation of any applicable laws
  • Harass, threaten, or abuse other users or our staff
  • Upload malicious code, viruses, or malware
  • Attempt to gain unauthorized access to our systems
  • Engage in fraud, identity theft, or misrepresentation
  • Reverse engineer or attempt to bypass security measures

15. Termination of Service

We reserve the right to terminate your access to the Service if you:

  • Violate these Terms and Conditions
  • Engage in illegal activities
  • Repeatedly violate payment obligations
  • Harass or threaten our staff or other users

Termination will be effective immediately upon notice, except where not permitted by law.


16. Applicable Law and Jurisdiction

(1) These T&C and all contractual relationships are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For consumers with their habitual residence in another country, the mandatory consumer protection provisions of their home country remain unaffected by this choice of law.

(3) If you are a commercial entity with your principal place of business in Germany, the exclusive place of jurisdiction is our registered office location in Germany.

(4) For all other cases, the place of jurisdiction is determined by applicable law.


17. Dispute Resolution and Complaints

(1) In case of disputes, we encourage you to contact us first at the address below to resolve the matter amicably.

(2) For EU consumers, disputes may be submitted to your national alternative dispute resolution (ADR) body.


18. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. We will replace the invalid provision with a valid one that most closely reflects the original intent.

20. Designer Rewards and Credit System

(1) Design Promotion and Rewards: Users may showcase their designs on our platform. When another user orders a design created by you, you will receive a credit reward as a thank you. This credit can be used to purchase postcards and other products on our platform.

(2) No Payout Guarantee: Any credits earned through design rewards are provided on a voluntary basis and WITHOUT ANY GUARANTEE OF PAYMENT OR PAYOUT. Card4U is not obligated to convert, refund, or pay out any credits in the form of cash or any other payment method.

(3) Credit Usage: Credits earned through the reward system may only be used to purchase postcards and other products on our platform. Credits cannot be transferred to other users, exchanged for cash, or used for any purpose outside of our Service.

(4) General Credit Terms: All credits acquired on our platform—whether earned through design rewards, promotions, or any other means—are non-refundable and non-transferable. No payout or cash conversion is available under any circumstances.

(5) Credit Validity: We reserve the right to determine credit validity periods and may remove unused credits after an extended period of inactivity, as announced on our website.

(6) Forfeiture of Credits: In case of account termination, violation of these Terms and Conditions, or fraudulent activity, all accumulated credits will be forfeited immediately without compensation.


21. Final Provisions

(1) These Terms and Conditions constitute the entire agreement between you and Card4U regarding your use of the Service and the purchase of postcards.

(2) We may update these T&C at any time. The most current version is always available on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the new terms.

(3) No waiver of any provision of these T&C is effective unless in writing and signed by both parties.
